AIR TRANSPORTATION: Air transportation (where included) is based on contracted bulk and publish fare(s) in economy class service. All fares are subject to change and are non-refundable. TopDestinations Inc. cannot assume responsibility for the default of any airline carrier. Once travel commences the ticket has no refund value or can any unused portion of this ticket be applied to the purchase of another ticket. Any changes made by the passenger during his/her trip will require the purchase of another ticket at the applicable fare from South America to the United States.

HOTELS: Accommodations are based on “run of the House” basis. Room assignments are made by hotel management upon arrival. We reserve the right to substitute hotels of the same or superior category.

CANCELLATIONS: Cancellations received over 45 days prior to departure will be subject to a minimum $ 250.00 per person administrative cancellation fee. Airline tickets are non-refundable and changes are subject to penalty and/or service fees plus difference of the fare if applicable. Additional per person penalties are as follows:

45-31 days prior to departure … $ 390.00
30-16 days prior to departure … 75 % of tour price
16-0 days prior to departure … 100 % of tour price

No refunds are paid for any unused portions of the tour. Changes in plans by the travelers during the trip are subject of penalties or non-refundable amount of the services cancelled. No refunds will be made for occasional missed meals or sightseeing tours. After any payment has been advised, a $35 fee will be charged per transaction for any changes made to dates, hotels, or to ground or air transportation.
New Year, Carnaval and Eastern Holiday is Non Refundable. Galapagos’s Cruises: Deposit is non refundable, Within 30 days prior to departure no refund allowed.

AIRPORT TAXES/CUSTOMS AND IMMIGRATION FEES: Departure tax within Latin America and/or customs and immigration fees are not included in our rates and must be paid directly by the passenger.

PRICE INCLUDES: Price includes all items listed under "Tour Includes", including charges for planning and operating the package.

PRICE DOES NOT INCLUDE: Federal Inspection Fees for the Federal U.S. Customs and Immigration; International Air Transportation Tax; agricultural tax; any other taxes; security fee; airport taxes and fees; port taxes; passports; visas and vaccinations; tips to your tour or cruise director; tour host, tour driver, local city guides, ships’ crew; gratuities on ferries, trains and cruise ships; laundry; telephone; mini bar; alcohol, beverages and food not on the regular d’hote menu (these extraitems will be billed you before leaving the hotel ship or restaurant); optional excursions; porterage at airports; travel protection; excess baggage fees; all other items of a personal nature.

VISAS AND PASSPORTS: All passengers must be in possession of a valid passport. You are responsible for obtaining and payment and payment for all visas and entry documents, and for meeting all health and other requirements and any documents required by laws, regulations, orders and/ or requirements of the countries to be visited. Multiple-entry visas are required for some vacations. Non-U.S. citizens must consult with appropriate consulates to determine if any visas are needed and are responsible for obtaining all visas and entry documents. All passengers traveling internationally are required to have a passport. Most countries require that the passport be valid for at least six (6) months beyond the conclusion of your trip. TopDestinations Inc. will no be held liable for trip cancellations or alterations occurring from lack of appropriate travel documents and no refunds will be considered for such instances.

BAGGAGE: On international flights, allowance in accordance with airline regulations. On sight-seeing vehicles and light aircraft, one suitcase per person is allowed (25 lbs. per person). LatinAmerica4Less accepts no liability for loss or damage to luggage; this is the travelers responsibility.

POSSIBLE CHANGES: We reserve the right to make reasonable changes and/or substitutions in the itinerary where deemed necessary for the benefit of all passengers.

SERVICE INQUIRES AFTER THE VACATION: If after returning from your vacation, you wish to inquire about any services provided, please ensure that all correspondence relating to those services is received by LatinAmerica4Less.com, TopDestinations Inc. within 60 days of the tour completion date. This will enable LatinAmerica4less.com to make a timely investigation.

TRAVELERS WHO NEED SPECIAL ASSISTANCE: You must report any disability requiring special attention to LatinAmerica4less.com at the time the reservation is made. LatinAmerica4less.com will make reasonable attempts to accommodate the special needs of disabled travelers, but is not responsible in the event it is unableto do so, nor is it responsible for any denial of services by carriers, hotel, restaurants, or other idependent suppliers. Be aware that outside the U.S. the Americans with Disabilities Act is not applicable and facilities for disabled individuals are limited. Most transportations services, including the touring motorcoach, are not equipped with wheelchair ramps. We regret that we cannot provide individual assistance to a vacation participant for walking, dining, getting on and off motorcoaches and other vehicles, or other personal needs. A qualified and physically able companion must accompany travelers who need such assistance and must assume full responsibility for their well being.

INSURANCE: We recommend that you purchase adequate and comprehensive travel accident insurance covering medical expenses, emergency assistance, baggage claims and trip cancellation or delay.

RESPONSIBILITY: TopDestinations Inc. act only as agents for the various companies, owners or contractors providing the means of transportation, accommodations and other services. TopDestinations Inc. does not own, manage. Control, promote, run or operate any transportation or recreational vehicle, motel, hotel, restaurant or any supplier of service. All exchanges orders, coupons and tickets are offered subject to a General Information under which such services are offered or provided. TopDestinations Inc. assume no liability in personal injury, illness or property damage or other loss or expense of any nature whatsoever arising directly out of any actions of any person or supplier of services providing any of the serviced, programs or accommodations offered in connection with a tour. TopDestinations Inc. assumes no responsibility at all and no liability at all for any death, injury, illness, quarantine, sickness, diseases, natural disaster, damage, loss delay, accident, expense, defect or any other abnormality which may result from your participation in any activity during the tour. TopDestinations Inc. can accept no responsibility for losses or accidental expenses due, as well, to delays or changes in schedules or departures, hotel over bookings or defaults, sickness, weather, strikes, war, quarantines, riots or insurrections or criminal acts committed by third parties, political disorders, of any type, or other such similar causes. All such losses or expenses will have to be borne by the passenger, who is again advised of the availability of travel accident insurance. Each exchange coupon, order and ticket is to be regarded as one contracted on or in behalf of the particular company or person name in it. The passenger contract in use by the airline or steamship company concerned, when issued, shall constitute the sole contract of air and steamship passage with the purchases of these tours and/or the passenger. The airline companies concerned are not be held responsible for any act, omission or event during the time passengers are not on board their planes or conveyances. The right is reserved to withdraw any tour announced in this program and to make such alterations to the itineraries as may be found desirable for the proper carrying out of the tours. In the event it becomes necessary or advisable in the Tour Operator discretion to alter the arrangements or itineraries for the passenger's comfort or welfare for any reason whatsoever, such alterations may be made without penalty to the Operator. Additional expenses, if any, shall be borne by the passenger. The right is reserved to decline, to accept or retain any person as a member of any group at any time. This program is issued on the sole responsibility of the Tour Operator. It is not issued on behalf of and does not commit any airlines whose services are used in the course of these tours.

ARBITRATION: Any controversy or claim arising out of or relating to this contact or the breach thereof shall be settled by arbitration in accordance with the uniform rules for binding arbitration of the BETTER BUSINESS BUREAU of the southland (published on www.labbb.org) in effect at the time of initiation of arbitration, and the judgment upon the award rendered by the arbitrator may be entered in any court havin jurisdiction thereof.
